1. Services

This website is owned and operated by Teacher Access ™ Pty Ltd, ACN 600 363 111 (Teacher Access™) and all responsibility in relation to the website remains with Teacher Access™ subject to the terms and conditions of use set out herein. The purpose of the website is to provide the "Services" to its subscribers and the "Services" are defined as follows:-

  1. the provision of an online portal which enables graduate teachers to upload their profile for the purpose of attracting interest from potential employers who are registered on the site and also to enable graduate teachers to continue to maintain ongoing education and to keep up to date with industry products, governance and changes in policy;
  2. an online portal to allow schools and other potential employers of teacher graduates to access and review the profiles of graduate teachers and to thereafter enable the schools, with the consent and subscription of the graduate teachers to the portal, to contact and book the graduate teachers for the purpose of considering employment opportunities both on a basis;
  3. ongoing education both online and face to face for teachers and others involved in the education sector;
  4. provision of helpline for teachers;
  5. provision of an online job search portal to enable schools and teachers to upload and search teacher vacancies on a weekly basis;
  6. electronic publication of information relevant to the education sector;
  7. provision of an online forum for education resources, including human resources, educational resources, educational materials and publications, training for the education sector, certification for practising teachers, benchmarking, blogging and profiling for teachers and others involved in the education sector.

In summary, the core purpose of the website is to provide an online portal which enables schools (and others who employ teachers) to view teacher profiles online (in particular graduate teachers) for the purpose of identifying employment opportunities and resourcing teacher needs within the education sector. Thereafter providing ongoing assistance to teachers by the provision of online and face to face educational courses, programs and other resources, including a help line so as to provide a self-sustaining and complete online resource for the education sector.

Teacher Access™ has put in place rules to ensure that information provided by third parties is accurate. Teacher Access™ reserves the right to remove information that breaches those rules and cancel subscriptions. All persons accessing this website, including subscribers, must ensure that they carry out their own investigation as to the accuracy, legitimacy and reliability of the information provided. Teacher Access™ gives no warranty and accepts no responsibility for any damage or loss that any person or entity may suffer as a result of relying on any information provided on this website.

2. Agreement

It is acknowledged by you as a visitor and/or a subscriber of this website that these Terms and Conditions are a binding agreement between you and Teacher Access™ and in the event that you do not agree with any of the Terms and Conditions set out herein, you should immediately leave the website and/or contact Teacher Access™ in writing with your concerns.

The Terms and Conditions together with any other policies, pricing or other documents expressly referred to herein or published from time to time by Teacher Access™, constitute the entire agreement between you and Teacher Access™. This supersedes all prior agreements or any other communication between you and Teacher Access™ whether that occurred prior to or after your access or subscription to this website unless specifically varied by Teacher Access™ in writing.

3. Intellectual Property

The contents of this website, including text, graphics, images and other material, are protected by copyright under Australian Law and in particular pursuant to the Copyright Act 1968 (Commonwealth). Unauthorised use of any material on this website may violate Teacher Access™ copyright, trademarks, confidential information and other rights and laws associated with the said material. You agree that you must not sell or modify the material or reproduce, display, publicly perform, distribute or otherwise use the material in any way for any public or commercial purpose. The use of the material on any other website or in any other electronic medium, disseminated to others or online generally for any other purpose is prohibited.

4. Website Use

Specific Prohibited Use. This website may only be used by subscribers for the lawful purposes associated with the services and in particular for the purpose of enabling graduate teachers and others employed in the education sector to seek employment and for employers to access profiled information provided by such persons for the purpose of seeking employees. Teacher Access™ specifically prohibits any use of the website, and requires all users and subscribers to agree not t use the website, for any of the following:

  • posting any incomplete, false or inaccurate resume information or information which is not the persons own resume (living individual seeking employment on a full time or part time basis on his or her own behalf);
  • posting non resume information such as opinions or notices, commercial or otherwise;
  • responding to an employment opportunity for any reason except to apply for the job;
  • soliciting an employer subscribers business by competitors is prohibited;
  • posting any pyramid scheme, club membership or distributorship arrangement or other business opportunity which requires an upfront or periodic payment, pays commission only (no significant salary), requires recruitment of other members sub-distributors or sub-agents;
  • posting any opinions or information relating to a subscriber’s performance, experience, rating, education, skills or personal creditability or integrity is strictly prohibited.

Users are Prohibited from Violating or Attempting to Violate the Security of the Website including, without limitation:-

  • accessing data not intended for such user or logging into a server or account which user is not authorised to access; or
  • attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation; or
  • attempting to interfere with service to any user, host or network, including, without limitation, by means of submitting a virus to the website, overloading, flooding, mail bombing or crashing; or
  • sending unsolicitored email, including promotions and/or advertising of products or services; or
  • forging any TCP/IP packet header or any part of the header information in any email or used group posting;
  • Violations of system or network security may result or civil or criminal liability. Teacher Access™ will investigate occurrences which may involve violations and may involve, and co-operate with law enforcement authorities in prosecuting users who are involve in such violation.

Users may not use the website, in order to transmit, distribute, store or destroy material:

  • in violation of any applicable law or regulation;
  • in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of Teacher Access™ or others or violate the privacy or publicity or other personal rights of others;
  • that is obscene, threatening, abusive or of a slanderous defamatory nature.
  • all users of the website, and in particular those who subscribe to the website and upload information to the website, acknowledge that all such information, data, text, messages and other materials, whether publicly posted or privately transmitted, are the sole responsibility of the person from which such content originated;
  • this means that each person posting information or material to the website is entirely responsible for such content. Teacher Access™ bears no responsibility in relation to such information or material and does not provide any screening service as to the nature, content or accuracy of such information or material. Teacher Access™ reserves a right to remove such material if it becomes evident to Teacher Access™ by third party complaints or otherwise, that such information or material is in breach of the Terms and Conditions of use of this website.

5. Subscribers

In addition to the warranties given above by each subscriber/user of this website, each subscriber agrees that Teacher Access™ may access, preserve, and disclose account information relevant to that subscriber to a subsidiary or affiliated entity or agent of Teacher Access™ for the purpose of providing the Services to you in an efficient manner. This includes the purpose of properly administering your account in accordance with the Terms and Conditions set out herein and the general operating and subscription rules adopted by Teacher Access™. This is on the proviso that Teacher Access™ will do so in good faith and with the general purpose of providing the Services to you in an efficient and effective manner while seeking to preserve the integrity of the website. Complying with any relevant laws associated with the operation of the website and provision of the Services, including privacy laws, will be upheld.

Each subscriber warrants that it has thoroughly reviewed all information that has been provided by the subscriber to the website and that it is accurate to the best of the subscriber’s knowledge and is not in breach of any third party rights associated with the information. At all times during their subscription to the website, the subscriber will continue to review the said uploaded information and ensure that it remains accurate and not in any way misleading.

Each subscriber understands and acknowledges that the Teacher Access™ Portal relies on teachers maintaining accurate availability on their profile. Teacher Access™ requests that teachers keep their availability status up to date. Schools reserve the right to remove teachers from their favourites list should teachers fail to maintain their status availability.

Each subscriber must be: of legal age and capacity, teacher qualified and accredited (according to their State or Territories requirements) and hold a Working with Children Check (or their State and Territories equivalent).

Viewing of subscriber profiles

Teacher profiles and contact details can only be viewed by registered schools. Teachers nominate regions they are available to work in. Any school within that region can only search and view teachers those teachers. Every teacher is presented with the option of accepting or rejecting a booking offer. If they receive offers from schools they don’t want to work at they can simply reject that booking offer.

Teachers can also nominate schools they don’t want to receive offers from which prevents them from receiving bookings from that school. Next to ‘accept’ or ‘reject’ offer is a checkbox which states ‘Exclude future booking offers from this school’. The teachers profile will no longer be available for viewing for that school. Excluded schools can be reinstated from the teachers’ exclusion table.

6. Teacher Access™ Liability

Material uploaded to this website by Teacher Access™ may contain inaccuracies or typographical errors. Teacher Access™ makes no representations about the accuracy, reliability or completeness of the website or the material located hereon. The use of the website and the material, including any material uploaded by subscribers, is at each users own risk.

Users and/or subscribers of this website, acknowledge and agree that they are solely responsible for the form, content and accuracy of any resume or material contained herein and placed by them on the website. Employer subscribers are solely responsible for their postings on the website and to ensure that they check and verify the accuracy, reliability and completeness of the information posted on the website and on which they intend to rely.

It is specifically noted that Teacher Access™ is not to be considered an employer or an agent of any potential employer with respect to a teacher subscriber of the website and in that regard Teacher Access™ shall not be responsible for any employment decisions, for whatever reason, made by an employer subscriber.

In particular, Teacher Access™ does not warrant that the website will operate error free or that the website and its server are free of computer viruses or other harmful mechanisms. If your use of the website or the material located on the website results in the need for servicing or replacing of equipment or data, Teacher Access™ shall not bear any responsibility for the cost associated therewith.

The website and the material are provided on an ‘as is’ basis without any warranties of any kind. Teacher Access™, to the fullest extent permitted by law, disclaims all warranties, including the warranty of merchantability, non-infringement of third party rights, and the warranty of fitness for particular purpose. Teacher Access™ makes no warranties about the accuracy, reliability, completeness, or timeliness of the material, services, software, text, graphics and links.

7. Consequential Damages

In no circumstances shall Teacher Access™, its suppliers, or any third parties mentioned on this website be liable for any damages whatsoever resulting from the use or inability to use the website and materials. This includes without limitations, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption, whether this be based on warranty, contract, tort or any other legal theories. This is the case, irrespective of whether Teacher Access™ is advised of the possibility of such damages or not.

This website contains links to third party websites. These links are provided solely as a convenience to you and not as an endorsement by Teacher Access™ of the contents of such third party websites. Teacher Access™ is not responsible for the content of linked third party sites and does not make any representations regarding the content or accuracy of materials on such third party websites. If you decide to access links to third party websites, you do so at your own risk.

9. Indemnity

Each subscriber agrees to defend, indemnify and hold harmless Teacher Access™, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from the subscriber’s use of the material or their breach of the terms of this agreement. Teacher Access™ shall provide notice to each subscriber promptly of any such claim, suit, or proceeding and shall assist the said subscriber, at the subscriber’s expense, in defending any such claim, suit or proceeding.

10. Term and Termination

It is agreed that in the event that any subscriber wishes to terminate his subscription to this website, subject to these Terms and Conditions, the said subscriber must provide Teacher Access™ with written notice (including email) at least thirty (30) days before the date that the subscriber would like to end its subscription. The subscription shall terminate at the end of that notice period and the subscriber acknowledges that its account will be suspended and it will be prevented from accessing the website once that notice period has lapsed.

In addition to the above, in the event that Teacher Access™ becomes aware that a subscriber or registered school user has breached the Terms and Conditions associated with the use of this website or failed to comply with any other rules of use as provided by Teacher Access™ the subscriber will be notified in writing by Teacher Access™. If the subscriber has failed to remedy the breach within thirty (30) days of the receipt of the notice from Teacher Access™, then Teacher Access™ may terminate the said subscriber’s subscription without further notice.

11. Teacher Access™ Helpline

In addition to the services set out above, Teacher Access™ provides a helpline service to teacher subscribers. The purpose of the Teacher Access™ helpline is to assist teachers with issues or concerns they encounter working as a teacher within the education sector and predominately in relation to classroom content and school curriculum and policies.

All Teacher Access™ helpline coaches are qualified educators with a good understanding of the education system within the relevant jurisdiction and the laws, regulations and policies associated therewith. All Teacher Access™ helpline coaches seek to provide practical assistance and support by providing information as a guide only. Teacher Access™ bears no liability or responsibility for any claims/damages or loss as a result of the guidance provided.

Helpline coaches are not qualified to provide personal counselling or give legal advice. Teacher Access™ strongly encourages any teacher subscriber suffering from personal issues such as depression, anxiety or other mental illness to immediately contact lifeline 131114 or emergency services 000.

In addition, Teacher Access™ is not a child wellbeing reporting agency. Teacher Access™ is obligated to remind teachers of their mandatory duty to report children at risk of harm. Section 27 of the Children and Young Persons (Care and Protection) Act 1998 states:
if:

  1. a person to whom this section applies has reasonable grounds to suspect that a child is at risk of significant harm, and
  2. those grounds arise during the course of or from the person’s work,

Teacher employees are required to report concerns about suspected risk of harm to children and young people to the appropriate Child Protection Authority in their State or Territory.

In accordance with privacy laws, all information provided by subscribers to a Teacher Access™ helpline coach will be strictly confidential and will not be disclosed by Teacher Access™ to any third party without the written consent of the subscriber unless Teacher Access™ is otherwise required by law to disclose such information to a government authority. All helpline coaches will be required to sign a confidentiality deed prior to commencing their role.

12. Fees and Payments

Teacher account holders

Once a subscriber has completed their registration and have provided the valid payment information, their account will be charged the reoccurring annual subscription fee. The full yearly subscription fee will be charged at the commencement of every 12 month subscription term. An email or SMS notice from Teacher Access™ will be sent to subscribers during the last month of their subscription term, notifying them that their 12 month subscription is due to expire.

If subscribers do not wish their subscription to be automatically renewed, subscribers must advise Teacher Access™ in writing up to seven days prior to the cessation of their current subscription. In the event that a subscriber does not notify Teacher Access™ in writing that they do not wish their subscription to be renewed, a 12 month subscription will automatically renew on expiry of the current subscription and their account will be charged the renewal fee. School registered holders

School account holders have free access to the relief teacher booking system and therefore are not bound by the Fees & Payments as set out above for teacher account holders who pay and have access based on a subscription arrangement. SMS costs come into effect for schools who choose to utilise the SMS option when booking. SMS rates can vary from when one teacher is contacted (38cents) up to when the maximum of five teachers are contacted (97cents). These rates may vary from time to time during the term of your subscription. Teacher Access™ will use its best endeavours to keep the SMS rates updated on the website.

The total SMS fee will be emailed to the school at the start of each term and will become due for collection 14 days after they have been issued. Billing details are viewable on the school profile section the Teacher Access™ portal. In the event that the said account is not paid within 14 days, Teacher Access™ reserves its right to cancel the schools subscription and take debt recovery action.

13. Changes and Notices

To improve and enhance the quality of services provided by Teacher Access™ some changes may be necessary. Teacher Access™ will notify subscribers and schools of any changes which affect their subscription and registration. Teacher Access™ will provide notices of changes to the Terms and Conditions or any other rules associated with the website or the Services provided by displaying notices or emailing links to such notices on the website. Subscribers are responsible for informing themselves of any changes by regularly reviewing these pages. If subscribers access the web site after changes are posted, they are taken to have accepted such changes. Notices will be sent to subscribers and schools at the email addresses provided by them as part of their subscription and registration.

14. Governing Law

The Terms and Conditions set out herein will be governed by the laws of New South Wales and disputes relating to them will be submitted to the exclusive jurisdiction of the Courts in New South Wales or any Australian Federal Court as may be necessary.
